Abstract:

:Following the reversal by the court of appeals of the injunction against federal funding of human embryonic stem cell research, Judge Lamberth has held such funding to be lawful and has dismissed the lawsuit. However, the litigation is likely to continue in the court of appeals and ultimately perhaps in the Supreme Court. The plaintiffs' arguments against funding human embryonic stem cell research are unlikely to succeed, but unfortunately litigation is an unpredictable process in which outcomes cannot be guaranteed.
